General Terms and Conditions of Use for Pink App Services

Before accessing the Pink App tool through its respective platform, the user must fully understand the content of this document. If necessary, any clarifications can be obtained by contacting Pink, as the use of the services provided by Pink will depend on the full, unrestricted, and unconditional acceptance of the following General Terms and Conditions of Use.

The Pink App tool is a platform that enables internal and external communication by granting individual licenses - per user - to use this tool and its related services. In addition to its own communication platform, it integrates with other communication applications of the user's choice, who is informed in advance about all the conditions of use for each of these integration modalities during the contracting process. Both Pink and the user have the duty to fully and unrestrictedly comply with all current legislation, especially the Constitution of the Federative Republic of Brazil, the Consumer Protection Code, the Civil Code, the Brazilian Civil Rights Framework for the Internet, the Brazilian Code of Advertising Self-Regulation, and the General Data Protection Law.

By agreeing to these General Terms and Conditions of Use for Pink App services, the user commits to using the Pink App tool and its respective platform exclusively for legal purposes and, consequently, not engaging in or inciting any illegal, fraudulent, obscene, criminal, discriminatory, hateful, and/or offensive conduct. Similarly, the user agrees not to publish false, incorrect, or misleading content during its use and acknowledges their full and exclusive responsibility for any damages caused to Pink and/or third parties in the event of the aforementioned behaviors being detected.

The user should regularly adopt preventive security measures, including but not limited to recurrent vulnerability analyses, risk management processes, use of certified antivirus programs, password protection mechanisms, and plans to respond to possible incidents, that are sufficiently capable of addressing related risks, including, but not limited to, using the services for purposes other than those contracted, unauthorized access to services by unauthorized individuals, data security, and/or fraud or any breaches of current legislation or these General Terms and Conditions of Use for Pink App services.

All copyrights, trademarks, patents, registrations, industrial designs, and other intellectual property rights of Pink must be respected. The user commits not to reproduce, decompile, or apply reverse engineering to the services accessed as a result of using the Pink App tool and its respective platform.

The user grants Pink the unrestricted right to exploit any and all information voluntarily provided in relation to the services rendered or the platform made available, including, but not limited to, suggestions and/or complaints, which, if accepted and implemented, will not entitle the user to any counterpart.

The services provided may be temporarily and occasionally interrupted for preventive maintenance, emergency repairs, updates, and/or due to network and/or equipment failures, and may also be discontinued at any time due to force majeure events. The user acknowledges that, in these cases, Pink will not be liable for lost profits and indemnifications for damages of any kind.

The user agrees to use the Pink App tool, its respective platform, and the other services offered by Pink, including all associated features and functionalities, in accordance with applicable laws, rules, and regulations or other restrictions of use and/or content that may exist.
